ESTATE ADMINISTRATION

"Probate assets" are those assets that someone leaves behind with no beneficiary listed. These assets must go through the Probate Court to be distributed. If a loved one dies with a Will, the court will distribute their assets as they directed. If a loved one dies without a Will, the Court will distribute their assets pursuant to the statute of descent and distribution.

Do you own a car or real estate? There is a common misconception that if someone doesn’t have a lot of assets they do not need a Will or a Trust. Did you know that to transfer most assets upon death outside of probate, you must have a beneficiary listed? If no beneficiary is listed, it is likely your assets will go through the probate process. We can help you avoid the probate process by using various methods to pass along your assets to the next generation.

LANDLORD-TENANT LAW

Do you have a tenant late on rent or in default of their lease? The State of Ohio provides two avenues on evicting a tenant depending on the reason for eviction. The first avenue is providing a three-day notice and can be given if the tenant is late on rent or is using, selling, or manufacturing illegal drugs. The second avenue is providing a thirty-day notice and can be given if the tenant is otherwise in default of their lease.
